DEPARTMENT OF ENVIRONMENTAL PROTECTION WATERWAYS REGULATION PROGRAM 

Notice of License Application pursuant to M.G.L. Chapter 91

Waterways License Amendment Application No. 23-WW14-0001-APP

Applicant:Chanda Kale 

Project Location: 23 Goulart Memorial Drive, Fairhaven, Bristol County 

Notification Date: March 7, 2024 

Public Hearing:March 14, 2024 

Public Comments Deadline:April 8, 2024  

Public Notice is hereby given of the Waterways Application by Chanda Kale requesting a Variance to seek relief from various provisions of 310 CMR 9.00 pertaining to a Nonwater-Dependent Facility of Private Tenancy, in order to maintain an existing residential dwelling and associated deck partially located within Flowed Tidelands of Buzzards Bay at 23 Goulart Memorial Drive in the Town of Fairhaven, Bristol County. The Department has determined that said project is Nonwater-Dependent.  

The Public Hearing for this Waterways Applica­tion will be conducted remotely via Zoom on Thursday, March 14, 2024 at 2:00pm. Prior to the meeting you can download and sign up for an account for this free software at https://zoom.us on your phone, tablet, desktop, or laptop computer.

MassDEP Waterways Program will conduct this hearing in order to receive information to be used in its decision on whether to grant a Waterways License pursuant to M.G.L. Chapter 91. 

The Department will consider all written com­ments on this Waterways Application received by Monday, April 8, 2024 (Public Comments Deadline). Failure of any aggrieved person or group of ten (10) citizens or more to submit written comments to the Waterways Regulation Program by the Public Comments Deadline will result in the waiver of any right to an adjudicatory hearing in accordance with 310 CMR 9.13(4)(c). The group of citizens must include at least five (5) citizens who are residents of the municipality in which the proposed project is located.
