PUBLIC HEARING NOTICE

Fairhaven Conservation Commission

Monday, June 26, 2023 at 6:00pm  

Fairhaven Town Hall, 40 Center Street

Fairhaven, Massachusetts 

Pursuant to Chapter 20 of the Acts of 2021, this meeting will be conducted in person and via remote means, in accordance with applicable law. This means that members of the public body as well as members of the public may access this meeting in person, or via virtual means. In person attendance will be at 40 Center Street, and it is possible that any or all members of the public body may attend remotely, with in-person attendance consisting of members of the public.  MGL, Ch. 30a, § 20(f) requires anyone that intends to record any portions of a public meeting, either by audio or video, or both, to notify the Chair at the beginning of the meeting.

The Fairhaven Conservation Commission will hold the following Public Hearings pursuant to the Massachusetts Wetlands Protection Act (M.G.L. c. 131, s. 40) and the Code of the Town of Fairhaven Chapter 192, Wetlands:

1. CON 023-342: 1 Pavillion Way, Assessor’s Map 29, Lots 004H & 41-60 and Map 41, Lots 60-67 & 74-81 Notice of intent filed by Michelle Robert Hoyt to restore Bordering Vegetated Wetlands. There had been removal of fill and there is now re-establishment of vegetation with an assessment and reporting through (3) growing seasons of the remedi­ated area. The property location is at Assessor’s Map 29, Lots 004H & 41-60 and Assessor’s Map 41, Lots 60-67 & 74-81.  

2. SE 023-1301, CON 019-062: 20 Balsam Street, Map 43C, Lot 031 Request for an Amendment to the Order of Conditions filed by Stephen Bowling. The relocation shifts the driveway from the middle of the lot toward the northern border by about 20 feet. Work to take place in Land Subject to Coastal Storm Flowage (F.E.M.A. Zone VE, E.18’), Coastal Beach and Coastal Bank at Assessor’s Map 43C, Lot 031.  

3. CON 023-357: 28 Welcome Street, Map 31B, Lot 1D Notice of Intent filed by Robert J. Rogers to construct a 20’x60’ paved driveway and installation of a 10’x16’ shed within the Buffer Zone to Bordering Vegetated Wetlands at Assessor’s Map 31B, Lot 1D.  

Information regarding remote meeting access, listed above, will also be provided on the Conservation Agenda posted on the Town’s website at least 48 hours prior to the meeting. 

Copies of the applications listed in this hearing notice may be viewed at the Conservation Office in Town Hall, located at 40 Center Street, Fairhaven, MA.
