NOTICE OF PUBLIC HEARING

Notice is hereby given that the Fairhaven Planning Board will conduct a Public Hearing at 6:30 p.m. on Tuesday March 24, 2020, in the Town Hall, 40 Center Street, Fairhaven, MA on a Text Amendment to the Fairhaven Zoning Bylaw that would allow
Special Permits to be valid for up to three years.
The purpose of the hearing will be to receive information and public comment on a Text Amendment to the Fairhaven Code Book, proposed by the Planning Board that would allow Special Permits to be valid for up to three years. Currently Special Permits are limited by Section 198-8.B to “… lapse if substantial use thereof or construction has not begun within two years, except for good cause.” The proposal would allow the Planning Board the ability to limit the validity of the Special Permit to if “…construction has not begun within two years, or, at the Planning Boards discretion, up to three years, except for good cause.” The flexibility to allow Special Permits up to three years would also affect and use the same language in Sections: 198.29.1.D[3] for Communication Services; 198.29.3.E(17) for Sexually Oriented Businesses; 198-29.5.G(3) and 198-29.5.M(3) for Wind Energy Facilities; and 198.29.6.I(3) for Solar Photovoltaic Energy Facilities (SPEF).
