Letter_Carr Should Resign

Carr Should Resign

The Hiller Avenue Subdivision carnage continues and some things are becoming clear. This is about much more than minor mistakes or missteps. Outwardly, this is about severe process violations of Planning Board Chapter 316 Procedures, Chapter 322 Subdivision and MGL Chapter 81s.

At the Planning Board hearing on 10/14/25 (see FNN 10/23/25* issue), it was apparent to me the Fairhaven Director of Land Use and Planning, forced to answer every single question while eight, elected officials were silent, could legally answer very little. The lifting of a Cease and Desist Order, the day after 10 new sets of prints were filed with the town, was curious and untimely. The Director during the hearing gave every indication, like a woman held hostage giving secret signals behind her back, that he was being used as the Chair’s scapegoat. There is so much discussion during closed executive sessions, it will take much time for public disclosures. There is a proposed Planning Board hearing in the near future to again address the issue.

On October 16, 2025, the Massachusetts Supreme Court enjoined the Massachusetts Appellate Court 07/08/25 decision, the Bristol County Superior Court 03/11/24 decision and the Fairhaven Planning Board 01/14/20 Denial of the 16-lot subdivision. Four strikes and you should be out. The entire property is located inside the residential no-build wind turbine setback.

It has been reported that The Fairhaven Director of Land Use and Planning has submitted his resignation, as he tries to separate himself from the toxic environment, salvage his career and continue to provide for his children. The prior Planning Board Chair was not re-elected. The current Planning Board Chair has resigned from her seat. The last piece requires the prior Interim-Chair, Patrick Carr, to act. Your resignation of your Planning Board seat is proper at this time. Do the right thing Mr. Carr. Resign!

Wayne Hayward, Fairhaven
