Pursuant to Chapter 20 of the Acts of 2021, this meeting will be conducted in person and via remote means, in accordance with applicable law. This means that members of the public body as well as members of the public may access this meeting in person, or via virtual means. In person attendance will be at 40 Center Street, and it is possible that any or all members of the public body may attend remotely, with in-person attendance consisting of members of the public. MGL, Ch. 30a, § 20(f) requires anyone that intends to record any portions of a public meeting, either by audio or video, or both, to notify the Chair at the beginning of the meeting.

The Fairhaven Conservation Commission will hold the following Public Hearing pursuant to the Massachusetts Wetlands Protection Act (M.G.L. c. 131, s. 40) and the Code of the Town of Fairhaven Chapter 192, Wetlands:
a. SE 023-1484, CON 023-473: 22 Silver Shell Beach Drive, Map 41, Lot 28 Notice of Intent filed by Viola Panagakos to remove the existing stone seawall and replace it with a (dry-laid) sloped stone rip-rap seawall. The entire site falls within Land Subject to Coastal Storm Flowage, Flood Zones VE (El. 20 & El. 23). The site contains coastal resource areas; Coastal Bank (top of stone seawall) and Coastal Beach at Assessor’s Map 41, Lot 28.
b. SE 023-1485, CON 023-474: 9 Carlton Avenue, Map 2, Lot 15 Notice of Intent filed by Teixeira Family Nominee Trust to remove the existing stone seawall and replace it with a (dry-laid) sloped stone (granite block) seawall. The entire site falls within Land Subject to Coastal Storm Flowage, Flood Zones VE (El. 15 & El. 18). The site contains coastal resource areas; Coastal Bank (top of stone seawall) and Coastal Beach at Assessor’s Map 2, Lot 15.
c. SE 023-___, CON 023-475: 164 Main Street, Map 12, Lot 7 Notice of Intent filed by Stephen & Janet Peters for seawall improvements to provide storm damage prevention to the property and single-family home. The westerly portion of the site falls within Land Subject to Coastal Strom Flowage, Flood Zone AE (El. 6’). Additionally, the site contains Coastal Bank (the vertical seawall), Coastal Beach, and Salt Marsh at Assessor’s Map 12, Lot 7.
d. SE 023-___, CON 023-476: 18 Silver Shell Beach Drive, Map 41, Lot 31 Notice of Intent filed by Deborah Lucey for the construction of a slope stone rip-rap seawall. Work to be performed within Land Subject to Coastal Storm Flowage, Flood Zone VE (El. 20’) and within the 100-foot Buffer Zone to Coastal Bank, Salt Marsh, Inter-tidal Shore, and Coastal Beach at Assessor’s Map 41, lot 31.
e. SE 023-___, CON 023-477: 350 New Boston Road Notice of Intent filed by Christopher and Dawn Walton to construct a 12’x24’ shed within the Buffer Zone of the BVW and applicant is proposing confirmation of the wetland line at Assessor’s Map 40, Lot 21.
f. SE 023-1450, CON 023-406: Sconticut Neck Road (Starboard Drive), Map 42, Lot 9C (ANR Lot 2) Request for an Amended Order of Conditions filed by Michael & Laura Smith to approve the revised plan, which depicts a reduction in the previously approved house and deck footprints, along with the approval of a proposed in-ground swimming pool and barn. The site falls within Land Subject to Coastal Storm Flowage, FEMA Flood Zone VE (El.17 & El. 19) at Assessor’s Map 42, Lot 9C.
Information regarding remote meeting access, listed above, will also be provided on the Conservation Agenda posted on the Town’s website at least 48 hours prior to the meeting.
