In accordance with MGL c. 40A, § 11, notice is hereby given that the Fairhaven Planning Board will conduct a Public Hearing at 6:30 P.M. on Tuesday March 26, 2024, at Town Hall, 40 Center Street, Fairhaven, MA. The purpose of the hearing will be to receive information and public comment on proposed revisions to the Town of Fairhaven Bylaws:
Make administrative changes, clarifications and corrections to §65-1 &65-3 (Planning Board), §198-15.C.(2) (Use Regulations), §198-19.B (Fences), §198-29.A(5) and B (Special Permit for Certain intensive nonresidential & multifamily site developments), §198-29.6.F and G(8) (Solar facilities), §198-33 (Definition and word use); §316 (Procedural Rules); §322 (Subdivision of Land)
Revise §198-16 (Use Regulations) and §198-32.1 (Accessory dwelling units) to make accessory dwelling units by-right. Revise §198-16 by adding health care, shipping containers, and storage units as uses and allowing body art establishments, artist studio/gallery, accessory apartment to a business, and semi detached dwelling by right in certain zoning districts. Revise §198-27.C(1) to allow parking in a setback in certain zoning districts. Revise §198-16 (Use Regulations) and §198-32.2 (Docks and Piers) to allow docks and piers by-right. Delete §306-1 (Fee schedule of Planning Board charges). Repeal and Replace § 198-31.1 and §322-26 with an amended §194 Stormwater Management Bylaw.
