TOWN OF FAIRHAVEN BOARD OF PUBLIC WORKS REQUEST FOR PROPOSALS
Town of Fairhaven, Massachusetts. Sealed bids for Construction of: FORCE MAIN ACCESS MANHOLES – PHASE 1 – CONTRACT 29 for the Town of Fairhaven, Massachusetts, acting by its Board of Public Works will be received at the Office of the Board of Public Works, 5 Arsene Street, Fairhaven, Massachusetts, until 1:00 o’clock P.M., prevailing time, on Thursday, May 11, 2023 and at that time opened publicly and read aloud in the adjacent meeting room. A Pre-bid meeting will be held on Friday April 28, 2023 1 o’clock P.M. on Microsoft Teams.
The proposed work to be done under this contract includes installing six access manholes, four on the South Street force main system and two on the Taber Street force main system and ancillary work including wastewater bypass pumping, environmental protection, and traffic management.
It is the intention of the Owner to award the Contract to the lowest qualified responsive bidder. The bidder must submit a bid on all items in the Schedule of Prices. The Owner reserves the right to award the Contract based on the lowest responsive and responsible bidder.
Bidders are responsible for assessing the actual field conditions at all the areas in which the work will take place prior to preparing and submitting a bid on this contract.
The Contract Documents, including Specifications and Drawings, may be examined at the Office of the Board of Public Works, 5 Arsene Street, Fairhaven, Massachusetts, and at the office of Stantec Consulting Services, Inc., 45 Blue Sky Drive, 3rd Floor, Burlington, Massachusetts, on and after Wednesday, April 12, 2023, Monday through Friday, between the hours of 8:30 a.m. and 4:00 p.m. Contract Documents may be viewed and downloaded as a Portable Document Format (PDF) file free of charge at www. accentblueprints.com. Copies may be obtained for a fee by completing an order online or by calling 978-362-8038 for each set. Completed orders may be picked up at the office of Accent Printing located at 99 Chelmsford Road, North Billerica, MA 01862 (978-362-8038), from 9 a.m. to 4 p.m. Copies may also be shipped to prospective bidders for an additional charge to cover handling and mailing fees. All payments for printing and shipping are nonrefundable. For addition to the project plan holder’s list to guarantee receipt of addenda, it is recommended interested bidders obtain the Contract Documents directly from Accent. Interested bidders will be prompted to register an email address with Accent to access the documents.
Each Bid must be accompanied by bid security in the form of a bid bond, certified check, treasurer’s check, or cashier’s check drawn on or issued by a responsible bank or trust company made payable to the Town of Fairhaven. The amount of such bid security shall be five percent of the value of the bid.
No bid may be withdrawn within sixty (60) days (not including Saturdays, Sundays, and legal holidays), after the date of opening thereof.
Contracts for work under this Proposal will obligate the Contractor and subcontractors not to discriminate in employment practices.
Attention of bidders is called particularly to the requirements as to conditions of employment to be observed and minimum rates to be paid under the contract.
All bidders shall comply with the requirements set forth in “The Commonwealth of Massachusetts Modified Supplemental Equal Employment Opportunity Anti-Discrimination and Affirmative Action Program,” “The Commonwealth of Massachusetts Supplemental Equal Employment Opportunity Anti-Discrimination and Affirmative Action Program Contract Compliance Procedure,” and the “Town of Fairhaven Minority Business Enterprise and Women Business Enterprise Program.”
A Performance Bond, and a Labor and Material Payment Bond, each in an amount equal to 100 percent of the Contract price will be required.
Prevailing Wage Rates as determined by the Deputy Director of Department of Labor and Workforce Development, Department of Labor Standards, under the provision of the M.G.L. Ch149, ss. 26 to 27H, as amended, apply to this project. It is the responsibility of the Contractor, before bid opening, to request, if necessary, any additional information on Prevailing Wage Rates for those trades people who may be employed for the proposed work under this Contract.
Liquidated damages in the amount of One Thousand Dollars ($1,000.00) per calendar day shall be affixed in accordance with the liquidated damages requirements stipulated in the Agreement.
The Contractor shall complete all work called for under the Contract Agreement in all parts and requirements within 360 calendar days as specified in the Proposal.
The successful bidder shall be required to submit documentation that all employees to be employed in the work subject to this bid have successfully completed a course in construction safety and health approved by the United States Occupational Safety and Health Administration that is at least 10 hours in duration. Any employee found on a worksite subject to this section without documentation of successful completion of a course in construction safety and health approved by the United States Occupational Safety and Health Administration that is at least 10 hours in duration shall be subject to immediate removal.
Bids for this contract are subject to the provisions of M.G.L. Chapter 30, Section 39M.
The right is reserved to waive any informalities in or to reject any or all bids received and to award the Contract to any of the contractors bidding on the work if, in the Town’s opinion, the best interests of the Town will thereby be promoted.
